Terms of Service

1. Acceptance of Terms

By accessing or using the Lexlint website, application, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

2. Description of Service

Lexlint is a web-based accessibility compliance scanning tool that identifies potential WCAG (Web Content Accessibility Guidelines) violations on websites and generates AI-powered remediation suggestions. The Service may reference various accessibility laws including AODA (Ontario), ADA Title II (United States), HHS Section 504, BFSG (Germany), and the EU European Accessibility Act.

3. Important Limitations of the Service

YOU ACKNOWLEDGE AND AGREE THAT:

3.1 Not a Guarantee of Compliance

Lexlint is a scanning tool that identifies a subset of automatable WCAG violations. No automated scanning tool can detect all accessibility barriers. Automated tools typically detect approximately 30-40% of WCAG success criteria. A scan score does not mean your website is legally compliant with any accessibility law.

3.2 Not Legal Advice

Lexlint is not a law firm and does not provide legal advice. References to accessibility laws are for informational purposes only. You should consult a qualified accessibility lawyer to determine your specific legal obligations.

3.3 Not a Substitute for Manual Testing

The Service uses automated scanning engines (including axe-core and Pa11y) and AI-generated fix suggestions. These have known limitations including inability to assess text alternative quality, cognitive accessibility, keyboard navigation in complex components, and contextual color contrast requirements. AI-generated suggestions may be incorrect or inapplicable. You are solely responsible for verifying any changes before implementing them.

3.4 AI-Generated Content

Certain features use artificial intelligence to generate remediation suggestions and reports. AI-generated content may contain errors. All AI output must be reviewed by a qualified human before implementation.

4. Your Responsibilities

You agree that:

  • You will not rely solely on Lexlint scan results to determine your legal compliance status
  • You will conduct manual accessibility testing in addition to automated scanning
  • You will consult qualified professionals regarding your compliance obligations
  • You will review all AI-generated suggestions before implementing them
  • You will not represent scan results as a legal compliance certification to any regulatory body or third party
  • You are solely responsible for your website's accessibility

5. Accounts and Subscriptions

You must provide accurate information when creating an account. Subscriptions are billed monthly or annually and automatically renew unless cancelled. You may cancel at any time through your account settings. Refund requests may be submitted within 30 days of initial purchase.

6. Acceptable Use

You agree not to: use the Service to scan websites you do not own or have authorization to scan, circumvent rate limits or technical restrictions, reverse engineer the Service, resell without agreement, use in violation of applicable laws, or misrepresent scan results as formal compliance audits.

7. Intellectual Property

The Service is owned by Lexlint and protected by intellectual property laws. Scan results and reports generated for your websites are your property.

8. Data Handling

We access publicly available HTML, CSS, and JavaScript to perform scans. We do not access private areas unless you provide credentials. See our Privacy Policy for details.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. LEXLINT DOES NOT WARRANT THAT THE SERVICE WILL IDENTIFY ALL ACCESSIBILITY BARRIERS, THAT RESULTS WILL BE ERROR-FREE, THAT AI SUGGESTIONS WILL BE CORRECT, OR THAT USE WILL ENSURE COMPLIANCE WITH ANY LAW.

IN NO EVENT SHALL LEXLINT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING REGULATORY FINES, LEGAL FEES, OR DAMAGES ARISING FROM RELIANCE ON SCAN RESULTS.

TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID TO LEXLINT IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Lexlint from claims arising from your use of the Service, reliance on results, violation of these Terms, or any third-party claim related to your website's accessibility.

11. Termination

We may suspend or terminate access for violation of these Terms with 30 days notice. You may terminate at any time through account settings.

12. Changes to These Terms

We may update these Terms from time to time with at least 30 days notice before material changes take effect.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

14. General Provisions

If any provision is unenforceable, the remainder stays in effect. Failure to enforce a provision does not waive it. These Terms constitute the entire agreement.
